Terms of Service

1. Acceptance of Terms
By accessing or using Kikaku's services, you agree to be bound by these
Terms of Service. If you do not agree to these terms, you may not use
our services.
2. Services
Kikaku provides application hosting, server management, and related
infrastructure services. We reserve the right to modify, suspend, or
discontinue any service at any time with reasonable notice.
3. Account Responsibilities
You are responsible for maintaining the confidentiality of your account
credentials. You agree to notify us immediately of any unauthorized use
of your account. You are responsible for all activities that occur under
your account.
4. Acceptable Use
By using our services, you agree not to engage in any activities that violate applicable laws or negatively impact our infrastructure or other users.
This includes, but is not limited to, conducting DDoS attacks, distributing illegal content, sending spam, infringing intellectual property rights,
engaging in cryptocurrency mining, or consuming excessive resources that degrade service performance for others.
Additional restrictions apply based on the service type:
4.1 Application Server
- Must not be used for cryptocurrency mining
- Must not be used to store or distribute illegal or copyrighted content without authorization
- Must not be used for unlawful activities or activities that violate applicable regulations
- Must not be used for abusive or large-scale scraping that impacts system performance
- Must not be used for spam or disruptive activities, including but not limited to Discord or Telegram bots
4.2 Virtual Private Server (VPS)
- Cryptocurrency mining is strictly prohibited
- Storing or distributing illegal or copyrighted content is not allowed
- Root access is granted — you are fully responsible for your server’s security and activities
- Running network scanning, port scanning, or exploitation tools is prohibited
- Outbound port 25 (SMTP) is blocked by default to prevent spam; you may contact support to request access
4.3 Game Server
- Must not be used for cryptocurrency mining
- Must not be used to store or distribute illegal or copyrighted content
- Must not be used to disrupt other players, servers, or network services
4.4 Web Hosting
- Hosting phishing websites, malware, or illegal content is strictly prohibited
- Adult content is only allowed with prior written approval
- Disk usage must remain within your plan limits; excessive inode usage may result in suspension
- Websites that generate excessive load or abuse shared resources may be limited or suspended
5. Payment & Billing
All paid services are billed on a recurring monthly basis unless otherwise specified.
Payments must be made in advance to ensure uninterrupted service.
Failure to complete payment by the due date may result in service suspension or termination without prior notice.
We reserve the right to reclaim resources from unpaid services.
5.1 Refund Policy
- All approved refunds will be issued as account credit and are non-transferable.
- Virtual Private Server (VPS): Refunds are not available for VPS services.
Exceptions may apply only if the service is confirmed to be unusable after investigation by our support team.
If the issue is caused by user actions or misconfiguration, no refund will be provided.
- Application Server / Game Server / Web Hosting: Refunds are available upon request.
The refunded amount will be prorated based on the duration of service usage,
and the remaining balance will be credited to your account.
- Custom Services: Any custom or special-request services, including but not limited to custom configurations,
dedicated setups, or tailored deployments, are strictly non-refundable under any circumstances.

Refund requests are subject to review and approval at our sole discretion.
You are responsible for ensuring that your billing information is accurate and up to date.
Any applicable fees, including payment processing fees, are non-refundable.
6. Uptime & SLA
We guarantee 99.0% uptime for all paid plans. In the event of downtime
exceeding our SLA, service credits may be issued upon request. The Dev
(free) plan does not include an uptime guarantee.
7. Data & Backups
While we perform automated backups, you are ultimately responsible for
maintaining your own data backups. We are not liable for data loss
due to user error.
8. Termination
We reserve the right to terminate accounts that violate these terms.
Upon termination, your data will be retained for 7 days before permanent
deletion, during which you may request an export.
9. Limitation of Liability
Kikaku is not liable for indirect, incidental, or consequential damages
arising from your use of our services.
10. Changes to Terms
We may update these terms from time to time. Continued use of our
services after changes constitutes acceptance of the new terms. We will
notify registered users of significant changes via email.
